1. INTRODUCTION & ACCEPTANCE OF TERMS
This website and all related adventure services are operated by Rinjani Trekking Center ("Company", "we", "us", or "our"). By accessing this website, making a booking, or participating in any trekking or outdoor activity organized by us, you ("Participant", "Customer", or "you") confirm that you have read, understood, and agreed to be legally bound by these Terms of Service ("Terms").
If you do not agree with any part of these Terms, you must not proceed with any booking or participation.
2. DEFINITIONS
"Participant" means any individual joining a trekking or related activity.
"Services" means trekking, guiding, porter services, transportation, accommodation, and logistics.
"Trekking Activity" means hiking, camping, mountaineering, and outdoor adventure activities.
"Mandatory Insurance" means mandatory trekking insurance included or required in the package.
3. MEDICAL FITNESS & FACILITATED SCREENING
Mandatory Certificate: A valid Medical Health Certificate (Surat Keterangan Sehat) is required by National Park (TNGR) authorities.
Facilitated Examination: The Company will facilitate the medical examination and provide this certificate as part of your package at no additional cost.
Fitness Declaration: Participants must truthfully declare any conditions such as heart disease, hypertension, or asthma during the check-in process.
Right to Deny: If a medical professional deems a Participant unfit for the trek, the Company reserves the right to deny participation for safety reasons without refund.
4. ASSUMPTION OF RISK
You acknowledge and understand that trekking on Mount Rinjani is a high-risk outdoor activity conducted in a remote volcanic environment.
Such activities involve inherent, foreseeable, and unforeseeable risks, including but not limited to:
Extreme weather conditions
Volcanic terrain and unstable ground
Falling rocks and landslides
Altitude sickness (Acute Mountain Sickness / AMS)
Slips, falls, and physical injury
Wildlife encounters
Delayed evacuation
Limited access to immediate medical facilities
Serious injury, permanent disability, or death
By choosing to participate, you voluntarily and knowingly assume all risks associated with the trekking activity, whether arising from natural conditions, terrain, other participants, staff actions, or unforeseen circumstances.
Participation is entirely voluntary, and you accept personal responsibility for your decision to join the activity.
5. SCOPE OF SERVICES & ITINERARY MODIFICATION
The Company provides trekking information, reservations, guiding services, porter services, and related logistics. All bookings are subject to availability and confirmation.
Operational Authority: The Company reserves the right to modify, shorten, reroute, or cancel any itinerary without prior notice due to:
Weather conditions or natural disasters.
Volcanic activity or National Park (TNGR) closures.
No Breach: Such modifications do not constitute a breach of contract and do not entitle the Participant to a full refund.
6. INSURANCE & LIMITATION OF LIABILITY
Mandatory Insurance
Participation in the trekking program requires mandatory trekking insurance coverage as determined by applicable regulations and Company policy.
All accidents, injuries, illness, evacuation, disability, or death arising during the trekking activity shall primarily be processed through the applicable insurance policy.
The Company shall assist in good faith with documentation and coordination of insurance claims but does not guarantee approval or coverage decisions made by the insurer.
Limitation of Liability
To the maximum extent permitted by the laws of the Republic of Indonesia:
The Company's total liability, if any, shall not exceed the total amount paid by the Participant for the relevant trekking package.
The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages.
Any medical, evacuation, or related costs exceeding the applicable insurance coverage shall be the sole responsibility of the Participant.
Nothing in these Terms excludes liability in cases of proven gross negligence (kelalaian berat) under Indonesian law.
7. BOOKING, PAYMENT & ADMINISTRATION
Confirmation: Bookings are only secured upon receipt of the required deposit/payment.
Price Fluctuations: Prices are subject to change due to increases in National Park fees, fuel, or government taxes.
Transferability: Bookings are non-transferable to other persons without written consent from the Company.
8. CANCELLATION & REFUND POLICY
The Company incurs costs (permits, logistics, staffing) well before the trek begins. Our policy is as follows:
IDR 300,000 per person per day is non-refundable (National Park ticket & insurance).
3% of the total paid amount is non-refundable (Payment processing fee).
Refund percentage is calculated after deducting the components above.

Refund will be processed within 7–14 business days to the original payment method.

9. INDEMNIFICATION
You agree to indemnify and hold harmless Rinjani Trekking Center from any claims, damages, or legal expenses (including attorney fees) arising from your breach of these Terms, your negligence, or any damage you cause to third parties or National Park property.
10. CRIMINAL ACTS & CONDUCT
Staff Conduct: The Company is not liable for criminal acts committed by staff or third parties acting outside their professional scope. Such acts are personal liabilities subject to Indonesian Criminal Law.
Prohibited Behavior: Illegal drugs, firearms, and environmentally damaging behavior (littering, damaging flora/fauna) are strictly prohibited. Participants may be removed immediately without refund for such conduct.
11. DOCUMENTATION & MEDIA RELEASE
The Company may take photographs or videos of Participants during the Services for marketing and promotional purposes (social media, website). By agreeing to these Terms, you grant us a royalty-free license to use such media. If you wish to opt-out, you must notify us in writing before the trek begins. Such media shall not be used in a defamatory or misleading context.
12. FORCE MAJEURE
The Company shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Company's reasonable control, including but not limited to: earthquake, volcanic eruption, fire, flood, war, strike, or government-mandated lockdowns.
14. MANDATORY CHECK-IN & LEGAL WAIVER
Upon arrival at our office or designated meeting point, every Participant is strictly required to sign a physical copy of the PARTICIPANT CHECK-IN & LEGAL WAIVER AGREEMENT. Participation is contingent upon the completion and signing of this document. Failure or refusal to sign shall result in denial of participation.
These Terms shall be governed by the laws of the Republic of Indonesia. Any disputes that cannot be settled through mediation shall be submitted to the exclusive jurisdiction of the District Court of Mataram (Pengadilan Negeri Mataram), West Nusa Tenggara.
